Dude gets on a bus with a rambo knife
Stabs a dude 40+ times
cuts his head off, guts him and by some accounts cannibalizes him in front of 34 people...

and this is 2nd degree murder. Does 2nd degree murder mean the same thing in Canada as it does in the US? Or is it more of an insanity thing?

If this actually stays as a 2nd degree murder (as we use it in the US), Canada's legal system is a joke.

My office mate, who used to be a psychologist, sent this to a titty joke mailing list that all of us co workers are on:

"Half an hour later, the attack began, Caton told the AP. 'There was no rage or anything. He was like a robot, stabbing the guy.'"

One of the standard descriptions of the violence of a paranoid schizophrenic in full blown psychosis, especially cutting off the head after the victim was probably already dead. They are usually emotionless and mechanical or wildly and deeply terrified, but seldom anything else.

My hypothesis based on the lack of fear:

He "heard" the person next to him saying "evil" things, then either another "voice" told him that meant the person next to him had to die, or he "decided" that he had to kill him to stop the "evil." When he kept hearing the "evil" talk after the victim was dead, he cut off the head in a further effort to stop it.

I've seen more or less the same pattern in other cases. In one I studied, the schizophrenic actually answered the doorbell in mid-decapitation, covered in blood and still carrying the knife, and politely asked the person at the door to come back later as he was a little busy just then. It's clear they have no real understanding of what they're doing.

There are many people who advocate for less eagerness to medicate the chronically mentally ill, and I actually count myself among them. We call it "chemical restraint." But when you see something like this, you realize that approach has severe limitations. Sure, doping him with Haldol isn't ideal for his personal growth. But neither is cutting people's heads off. Given the choice, I'd say any reasonable person would choose the drugs.

My guess, since this is the situation in some other places (if my keen knowledge of the law via the tv show Law & Order is accurate :lol:) 1st degree murder may be reserved for when someone kills, for instance, a police officer, or someone else who's life is more precious than that of an ordinary citizen.
