That record has been in the news quite a bit lately. Fucked up, sure. But it's not that simple.
The Beastie Boys originally cleared the recording but not the composition (three notes). Yauch, in an open letter to the Washington Post, explained:
[i]When we originally wanted to use the sample in 1992, we contacted ECM Records, the label that Newton gave permission to license the sound recording of “Choir,â€
