If I name my band "The New Paul McCartney", will I be humped in the pooper by Sir Paul's legal team?

The only band that I'm familiar with that had a problem with copyright/name stuff was Arcwelder.

They started out as "Tilt-A-Whirl", and the Selmer company that manufactured the fun-ride of the same name found out and made them change it.

I believe Captain America (later Eugenius) and REO Speedealer (later Speedealer) were forced to change their names as a result of legal threats.

under copyright law, there are fair use exceptions for social commentary and parody. i am not a copyright lawyer, so don't quote me. I suspect you might have a good argument if you got hauled into court, but it would cost you so much in legal fees just to get to the point where you could make your argument, it might not be worth it. And you could lose too.

Friends of Dean Martinez started out as Friends of Dean Martin.

Sometimes legal action can be a blessing, eh?

I don't think you'll be humped by anyone if you name your band "The New Paul McCartney".

Perhaps The Chicago Paul McCartney would be safer, given the precedent.

wasn't there a Dinosaur and they had to append the JR.

Century Rocket Building were briefly called Steve Turner's New Band.
We didn't change it for legal reasons.


We were thinking of the Steve Turner from Mudhoney
