most states in america recognize unwitnessed "holographic" wills. this means you need no attorney nor notary to have a court recognize (accept into probate) your will, however, having a witness helps. in the remaining states witnessed holographic wills are generally recognized. in order for a court to recognize a holographic will as a legal document it must be:

1. handwritten, not while under duress, and the document should specify that.
2. dated
3. signed by the living writer (testator) of the instrument.

to bypass the probate process establish a living trust for your assets.

having a will or trust, with an executor (for a will) and successor trustee (for a trust, after you die) you REALLY REALLY trust will save your family and friends a shitload of headache and grief.
