I'm a very optimistic person when it comes to this kind of thing, but one thing that's become clear over the last 4 years: If you ever want to be wrong, one surefire way to do so is to be optimistic about George W. Bush. The nominee will be a complete neanderthal, no doubt. There can be some optimism when it comes to the nominee not being confirmed, but even that seems like kind of a long shot.

In his nominations for major posts, Bush has demonstrated his willingness to nominate extreme candidates: Ashcroft (AG1), Gonzalez (AG2, Geneva convention "quaint"), Wolfowitz (World Bank), Bolton (UN). Given this history, and his own statement that Antonin Scalia provides a model for jurisprudence, I would expect nothing less than a Robert Bork type nominee. Hell, he should just get it overwith and nominate Bork. He'd get confirmed this time.

I think it is highly unlikely that this adminsitration would respond to lulling popularity by making motions toward the middle, especially w/r/t a Supreme Court appointment. (I'd bet half my ass that they won't even acknowledge the polls at all. If they do, it will be some trite cowboy comment about freedom not comin' cheap or easy.) Popularity might have been waned, but the power they hold hasn't really shifted in any fundamental way. They have the House and Senate, which means elected D's need them a lot more than they need us. It doesn't seem that lagging "popularity" matters much when you are a second term president and the next election is so far away. If these numbers were showing up in July, 2008, however, I'd have y'all over for a drunken hoe-down.
